PRIVACY AND COLLECTION NOTICE

This Privacy and Collection Notice (this “Notice”) explains the personal information that Pioneer Electronics (USA) Inc. (“Pioneer,” “we” or “us”) collects, uses, and or / discloses (“processes”) from residents of Canada (“you,” “your”) when you interact with: 1) pioneerelectronics.ca and any other Pioneer website that links to this Notice (each, a “Website,” and together, “Websites”); 2) our service providers; 3) third parties whom you have authorized to provide us with information, such as our authorized dealers, 4) email communications; and 5) offline interactions with you, such as when you call Pioneer Customer Service. This Notice also describes your rights with respect to your personal information that we process and how to exercise them.
For the purposes of this Notice, personal information means any information that is about an identifiable individual.
BY ACCESSING OR USING ANY WEBSITE OR PROVIDING US WITH YOUR PERSONAL INFORMATION, YOU ACKNOWLEDGE THAT YOU UNDERSTAND, ACCEPT, AND CONSENT TO THE PRACTICES AS DESCRIBED IN THIS NOTICE.
WHAT PERSONAL INFORMATION DOES PIONEER COLLECT AND FOR WHAT PURPOSES?
Below are: i) the categories of personal information Pioneer currently collects and during the 12 months preceding the Last Update of this Notice has collected, ii) the categories of sources of that information, iii) the purposes for such collection, and iv) whether the information is disclosed to third parties. For purposes of this Notice, including the following chart, “third party” does not refer to our service providers, which use the personal information solely to provide us services, such as a company that delivers emails to our customers on our behalf and does not use those email addresses for other purposes.

DOES PIONEER SELL PERSONAL INFORMATION?
Pioneer does not sell or share your personal information.
“Selling” for this purpose means selling or making available personal information to a third party for money or for other valuable consideration.
“Sharing” for this purpose means making available personal information to a third party for cross-context behavioral advertising, which means targeted advertising to a person based on the person’s activity across businesses, websites, apps, or services.
TO WHOM DOES PIONEER DISCLOSE MY PERSONAL INFORMATION?
We disclose personal information to our affiliates (for example, our parent company) and to our service providers (including where they collect personal information on our behalf), for the purposes described above. Pioneer may also disclose personal information: i) to certain of its business partners who provide services that complement or interoperate with our products and services; ii) if required by law, court order or governmental regulation, such as in response to a subpoena, other legal process, or where we elect to comply with a law enforcement or other government request; iii) to report activities we reasonably believe to be unlawful; or iv) as necessary to exercise our legal rights, defend claims brought against us, or otherwise protect our interests.
Google Analytics: Our Websites use Google Analytics, which reports aggregate traffic to the Websites so we can learn how the Websites are used, diagnose problems, and improve the Websites. Google Analytics also reports aggregate usage statistics for videos embedded on the Websites through Google’s YouTube service. When you interact with Google services through the Websites, your information is collected and processed by Google in accordance with Google’s privacy policy, which can be found at https://policies.google.com/privacy.
In accordance with applicable law, we may also disclose personal information to an actual or potential buyer or successor in the event of a merger, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets.
WHERE DOES PIONEER STORE MY PERSONAL INFORMATION?
We may process, store, and transfer your personal information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. Whenever we engage a service provider, we require that its privacy and security standards adhere to this Notice and applicable Canadian privacy legislation.

HOW LONG DOES PIONEER RETAIN MY PERSONAL INFORMATION?
Your personal information will be retained as long as necessary to achieve the purposes for which it was collected and in accordance with Pioneer information retention policies. Pioneer’s retention policies are generally based on legally required retention periods and/or retention periods Pioneer determines is necessary or advisable to operate Pioneer’s business.
HOW DOES PIONEER ENSURE MY PERSONAL INFORMATION IS ACCURATE?
We use reasonable efforts to ensure that your personal information is kept as accurate, complete, and up to date as possible. We do not routinely update your personal information, unless such an update is necessary. To help us maintain and ensure that your personal information is accurate and up to date, you must inform us, without delay, of any change in the information you provide to us.
HOW DOES PIONEER PROTECT MY PERSONAL INFORMATION?
While we use reasonable physical, technical, and organizational security measures to protect the personal information we collect from you, no security system is perfect, and we cannot guarantee that your information will remain secure in all circumstances. Any transmission you provide is at your own risk. Once we have received your information, we will apply our security practices to try to prevent unauthorized access, use and/or disclosure.
WHAT ARE MY RIGHTS REGARDING MY PERSONAL INFORMATION THAT PIONEER MAY HAVE?
Depending upon the province in which you reside, you may have some or all of the following rights with respect to our use of your personal information:
(a) Access: You have the right to request whether we hold personal information on you and to request a copy of such information. To do so, please use our privacy request form here: http://pioneerelectronics.com/privacyrequest-en. There are exceptions to this right, so that access may be denied if, for example, making the information available to you would reveal personal information about another person, or if we are legally prevented from disclosing such information.
(b) Accuracy: We aim to keep your personal information accurate, current, and complete. We encourage you to promptly update your personal information within your Pioneer account if you have one, or contact us to let us know if your personal information is not accurate or has changed.
(c) Withdraw Consent: If you have provided your consent to the processing of your personal information, you have the right to fully or partly withdraw your consent. To withdraw your consent, please follow the opt-out links on any marketing message sent to you, update your preferences within your Pioneer account, or contact us as described below.
Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose(s) to which you originally consented unless there is another legal ground for the processing. Withdrawal of consent to receive marketing communications will not affect the processing of personal information for the other purposes described in this Notice.
(d) Cessation of Dissemination: You have the right to request that we cease disseminating your personal information if the dissemination is contrary to the law or a court order.
You also have the right to request that we cease disseminating your personal information where the following conditions are met:
(i) the dissemination of the information causes you serious injury in relation to your right to have your reputation or privacy respected;
(ii) the injury is clearly greater than the public’s interest in knowing the information or the interest of any person’s right to express themselves freely; and
(iii) the cessation of dissemination requested does not exceed what is necessary for preventing the perpetuation of the injury.
(e) De-indexation: You have the right to request that we de-index any hyperlink attached to your name that provides access to information by a technological means if the dissemination is contrary to the law or a court order.
You also have the right to request that we de-index a link providing access to information where the following conditions are met:
(i) the dissemination of the information causes you serious injury in relation to your right to have your reputation or privacy respected;
(ii) the injury is clearly greater than the public’s interest in knowing the information or the interest of any person’s right to express themselves freely; and
(iii) the cessation of dissemination requested does not exceed what is necessary for preventing the perpetuation of the injury.
(f) Re-indexation: You also have the right to request that we re-index a link providing access to information where the following conditions are met:
(i) a failure to do so causes you serious injury in relation to your right to have your reputation or privacy respected;
(ii) the injury caused by a failure to re-index is greater than the public’s interest in knowing the information or the interest of any person’s right to express themselves freely; and
(iii) the re-indexation requested does not exceed what is necessary for preventing the perpetuation of the injury.
(g) Mobility: You have the right to request that computerized personal information collected from you be communicated to you in a commonly used technological format as well as to any person or body authorized by law to collect such information. This right does not extend to information that was created or inferred from your personal information and we are under no obligation to communicate such information if doing so raises serious practical difficulties.
(h) Complaints: If you believe that your personal information protection rights may have been violated, you have the right to lodge a complaint with the applicable supervisory authority, or to seek a remedy thought the courts.

You may, at any time, exercise any of the above rights by using our privacy request form here: http://pioneerelectronics.com/privacyrequest-en, or inquire about your rights or this Notice by contacting the Chief Privacy Officer via email to Canadaprivacy@pioneerusa.com. We will generally respond to all access requests within 30 days of the receipt of all necessary information. In circumstances where we are not able to provide access, or if additional time is required to fulfill a request, we will advise you in writing.
We may not release certain types of information based upon exemptions specified in applicable laws. Where possible, we will sever the information that will not be disclosed and provide you with access to the remaining information. Should we be unable to provide access to or disclose personal information to you, we will provide you with an explanation, subject to restrictions.
In certain circumstances, such as where the request is excessive or unfounded, we may charge you an administration fee for access to your personal information. We may also charge for additional copies. We will advise you of any fees before proceeding with a request.
Any report, concern, complaint or incident of which we become aware that involves conduct that may contravene the Notice will be treated confidentially to the extent possible. However, some disclosure may be necessary to adequately address issues raised, aid enquiry and implement solutions, as appropriate.
We will not retaliate against a person who, in good faith and on the basis of reasonable belief, raises questions or concerns regarding their personal information.
WHAT ABOUT CHANGES TO THIS NOTICE?
We reserve the right to amend this Privacy and Collection Notice at any time. When we make changes, we will post the updated Notice on our websites, including the date of its last update.
